These Terms govern your use of the Daata App, operated by Daata. By creating an account or using Daata, you agree to these Terms. If you do not agree, do not use the App.

1. What Daata is

Daata is a hyperlocal platform that lets people give away items for free and find free items offered by others. Daata is a venue that connects givers and receivers. All items must be offered free of charge. Daata does not buy, sell, own, inspect, deliver, or guarantee any item, and is not a party to any exchange between users.

2. Platform Role & Safety Disclaimer (please read carefully)

Daata is only an aggregator and listing platform. We simply connect people who want to give away an item with people who want to receive it. We are a neutral venue — we are not a party to any exchange, and we do not buy, sell, own, store, inspect, deliver, verify, or guarantee any item, user, or listing.

We do not verify users or the truth of any listing or message. We do not run background checks on any user.

Your safety is your own responsibility. All contact, travel, meetings, pickups, and hand-overs between users happen entirely at your own risk. If you choose to travel to a location to collect or hand over an item, or to meet another user, you do so of your own free will and Daata takes no responsibility for your safety.

To the maximum extent permitted by law, Daata is not responsible or liable for any harm of any kind — including personal injury, illness, death, assault, theft, robbery, fraud, loss, property damage, emotional distress, or any accident or tragedy — and is not responsible for any act, omission, conduct, dispute, or crime by any user or other third party, whether occurring online or in person, arising out of or connected with the App, a listing, a message, a meeting, or an exchange. You use Daata and meet other users at your sole risk.

Stay safe: meet in a public, well-lit place during daytime; tell a friend or family member where you are going; don’t go alone if you feel unsure; never share financial or sensitive personal information; inspect items yourself; and trust your instincts. If you feel unsafe, do not proceed and contact your local authorities.

By using Daata, you acknowledge and accept that you are solely responsible for your own safety and decisions, and you agree that Daata shall not be held liable for any consequence of any interaction or exchange between users.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Daata. If you are under 18, you may use Daata only with the involvement and consent of a parent or legal guardian. By using Daata you confirm you meet these requirements.

4. Your account

  • You must provide accurate information and keep your password confidential.
  • You are responsible for all activity under your account.
  • Notify us at support@daata.in of any unauthorised use.

5. Community rules — your responsibilities

You agree not to:

  • Offer, request, or exchange any prohibited or illegal item, including: weapons, ammunition, drugs, alcohol, tobacco, prescription medicines, hazardous/recalled goods, counterfeit goods, stolen property, live animals, adult/sexual content, or anything whose giveaway is restricted by law.
  • Ask for or offer money or any payment for items, or use Daata for commercial selling or solicitation.
  • Post false, misleading, infringing, hateful, harassing, or unlawful content.
  • Harass, threaten, defraud, impersonate, or endanger other users.
  • Collect or misuse other users’ personal information, or spam.
  • Interfere with, scrape, or attempt to breach the security of the App.

We may remove content, limit features, or suspend/terminate accounts that violate these rules, with or without notice.

6. Content you post

  • You keep ownership of the content you post (listings, photos, messages, reviews).
  • You grant Daata a non-exclusive, worldwide, royalty-free licence to host, store, display, and distribute that content solely to operate and provide the App (for example, showing your listing to nearby users).
  • You are solely responsible for your content and confirm you have the rights to share it.

7. Exchanges and in-person meetings

  • All arrangements, communications, and in-person hand-offs happen directly between users. Daata is not involved in and is not responsible for any meeting, exchange, or the condition, safety, legality, or quality of any item (see also Section 2).
  • Meet in safe, public places; do not share sensitive personal/financial information; use your own judgement.
  • Items are provided “as is”, with no warranty of any kind from Daata or, unless stated, from the giver.

8. Reviews, reports, and moderation

You can rate users, report listings, and block users. We may use reports to moderate the platform but are not obligated to monitor all content. Reviews must be honest and not abusive.

9. Notifications and location

By enabling notifications or location, you consent to receive notifications and to location-based features as described in the Privacy Policy. You can disable these at any time in your device settings.

10. Termination

You may stop using Daata and delete your account at any time (see the Account Deletion policy). We may suspend or terminate access if you breach these Terms or to protect the service or other users.

11. Disclaimers and Limitation of Liability

  • The App is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.
  • Daata is a neutral platform only. Daata is not responsible or liable for the conduct of any user, for the existence, condition, safety, legality, quality, or description of any item, or for any loss, injury, illness, death, theft, damage, accident, or tragedy arising from any interaction, communication, meeting, travel, or exchange between users — whether online or in person. Any meeting or collection of an item is undertaken entirely at your own risk.
  • Daata does not guarantee the identity, trustworthiness, or intentions of any user, and does not verify listings.
  • To the maximum extent permitted by law, Daata’s total aggregate liability for any claim relating to the App is limited as permitted by applicable law.
  • Nothing in these Terms excludes any liability that cannot be excluded under applicable law (for example, certain consumer protections); those mandatory rights are unaffected.

12. Indemnity

You agree to indemnify and hold Daata harmless from claims arising out of your content, your use of the App, or your breach of these Terms or of any law or third-party rights.

13. Changes to these Terms

We may update these Terms. Continued use after changes means you accept the updated Terms. We will update the “Last updated” date and, where appropriate, notify you in the App.

14. Governing law

These Terms are governed by the laws of India, and you agree to the exclusive jurisdiction of the courts of Kolkata, India, subject to any mandatory rights you have under local law.
